Lately the Supreme Court has been making it more difficult to achieve trade dress protection. Nevertheless, we've succeeded in achieving trade dress protection for our clients, counseling them on how to achieve and evidence such rights in their designs. We have obtained federal trademark registrations for trade dress designs, including for watches, pens and for packaging. In 2004 we litigated and won our client's trade dress case, obtaining not only an injunction but money damages as well.
